ADSp 2017
German Freight Forwarders' Standard Terms and Conditions 2017
Our terms and conditions
We work exclusively on the basis of the German Freight Forwarders' Standard Terms and Conditions 2017 (Allgemeine Deutsche Spediteurbedingungen 2017 – ADSp 2017).
The ADSp 2017 are the standard terms and conditions used in Germany for freight forwarding, carriage and warehousing. They were drawn up jointly by the associations of the shipping industry and the logistics sector and govern, among other things, obligations, liability and insurance in connection with transport and storage.
In clause 23, the ADSp 2017 deviate from the statutory maximum liability for damage to goods (section 431 of the German Commercial Code, HGB) by limiting liability to 2 SDR/kg for multimodal transport including carriage by sea and where the place of damage is unknown, and otherwise by limiting the standard liability of 8.33 SDR/kg additionally to EUR 1.25 million per claim and EUR 2.5 million per damage event, but at least 2 SDR/kg.
